Kohtulahend vaidluses Kantauro OÜ’ga
Teade
26.05.2015 tegi Harju Maakohus otsuse tsiviilasjas „Nordecon AS hagi Kantauro
OÜ vastu võla nõudes.“
Nordecon AS ehitas Kantauro OÜ tellimusel Tallinnasse ligi 15 000 m2
netopinnaga Stroomi kaubanduskeskuse. Stroomi Keskus avas külastajatele oma
uksed 04.12.2014, kuid kahjuks jättis arendaja ehitajale osa lepingulistest
summadest tasumata. Kuna Kantauro OÜ vaatamata korduvatele palvetele võlgnevust
ei likvideerinud, oli Nordecon AS oma huvide kaitseks sunnitud pöörduma
kohtusse.
Arvestades, et Kantauro OÜ hagile vastuväiteid ei esitanud, tegi kohus
nimetatud kohtuasjas tagaseljaotsuse ja rahuldas Nordecon AS’i hagi täies
ulatuses. Kohtuotsuse kohaselt mõisteti Kantauro OÜ-lt Nordecon AS-i kasuks
välja põhivõlgnevus summas 201 tuhat eurot ja hagiavalduse esitamise ajaks
kogunenud viivisvõlgnevus 316 tuhat eurot, samuti kaasnenud menetluskulud.
Kantauro OÜ’l on õigus otsus 30 päeva jooksul edasi kaevata.
Nordeconi kontsern hõlmab ettevõtteid, mis on keskendunud hoonete ja rajatiste
ehitamise projektijuhtimisele ja peatöövõtule. Geograafiliselt tegutsevad
kontserni ettevõtted täna Eestis, Ukrainas ja Soomes. Kontserni emaettevõte
Nordecon AS on registreeritud ja asub Tallinnas, Eestis. Kontserni kuulub
lisaks emaettevõttele üle 10 tütarettevõtte. Kontserni 2014. aasta
konsolideeritud müügitulu oli 161 miljonit eurot ja puhaskasum 2,3 miljonit
eurot. Nordeconi kontsern annab hetkel tööd üle 710 inimesele. Alates
18.05.2006 on emaettevõtte aktsiad noteeritud NASDAQ OMX Tallinna Börsi
põhinimekirjas.

Court judgment regarding the dispute with Kantauro OÜ
Teade
On 26 May 2015 the Harju County Court made a judgment in civil case “The
statement of claim of Nordecon AS against Kantauro OÜ in payment-claim”.
Nordecon AS constructed in Tallinn the Stroomi Shopping Centre with net area of
ca 15 000 square meters in the request and order of Kantauro OÜ. The Stroomi
Shopping Centre opened its doors to the visitors on 4 December 2014, but
unfortunately the developer left some of the contractual amounts due unpaid to
the constructor. As Kantauro OÜ did not pay the amounts due despite several
repetitive requests, Nordecon AS was forced to recourse to the court to protect
its interests.
Taking into account that Kantauro OÜ did not submit any objections to the
statement of claim, the court made a judgment by default in the referred matter
and satisfied the statement of claim of Nordecon AS in full. Pursuant to the
court judgment Kantauro OÜ is ordered to pay Nordecon AS the principal sum in
the amount of 201 000 euros and also penalties for late payment in the amount
of 316 000 euros that had accumulated by the time of submission of the
statement of claim, also the procedural costs that arose due to the dispute.
Kantauro OÜ has the right to file an appeal within 30 days after the service of
the judgment.
