Kolmandate osapoolte kohtuvaidlus seoses Purtse tuulepargi kasutusloaga

Tartu Halduskohus otsustas oma 21. detsembri 2023 kohtumäärusega võtta menetlusse kolmanda osapoole Eesti Ühistuenergia OÜ kaebus Lüganuse valla vastu. Kaebaja taotleb Enefit Wind Purtse AS-le antud Purtse tuulepargi kasutuslubade tühistamist. Kohus andis kaebajale esialgse õiguskaitse, mille kohaselt tuleb Purtse tuulepargi võimsust piirata 3 megavatile tuuliku kohta (kokku 5 x 3 MW installeeritud 5 x 4,2 MW asemel). Kasutusload on Purtse tuulepargile antud ehitusloa alusel, mille järgi on tuulikute võimsus 5 x 4,2 MW. Kaebajale kuulub naabruses asuv 5 tuulikuga tuulepark ning ta väidab kaebuses, et tema huvid on kahjustatud seoses Purtse tuulepargist lähtuva varjutusefektiga. Enefit Green leiab, et kasutusload on väljastatud õiguspäraselt ja kavatseb esialgse õiguskaitse seadmise vaidlustada. Enefit Green teatas 20. septembril 2022 sama kaebaja hagist Enefit Wind Purtse AS vastu (link börsiteatele (https://view.news.eu.nasdaq.com/view?id=b97c14c353c4ad1ab0a467ccb54f4e493&lang= et&src=listed)), millega taotleti Purtse tuulepargi ehituse peatamist. Viru Maakohus rahuldas esialgse õiguskaitse avalduse, mille kohaselt ehitus peatati. 24. novembril 2022 esialgne õiguskaitse tühistati ja ehitus jätkus vastavalt kehtivale ehitusloale. Court dispute between third parties regarding the use permits of Purtse wind farm

By order of 21 December 2023, the Tartu Administrative Court decided to hear the complaint of a third party, Eesti Ühistuenergia OÜ, against Lüganuse municipality. The applicant seeks the revocation of the use permits of Purtse wind farm granted to Enefit Wind Purtse AS. The court granted the applicant interim relief, according to which the capacity of the Purtse wind farm must be limited to 3 MW per wind turbine (a total of 5 x 3 MW instead of the installed 5 x 4.2 MW). The use permits have been granted to the Purtse wind farm on the basis of a construction permit, according to which the capacity of the wind turbines is 5 x 4.2 MW. The applicant owns a neighbouring wind farm with 5 wind turbines and claims that its interests have been damaged due to the wake effect stemming from Purtse wind farm. Enefit Green is of the opinion that the use permits have been issued lawfully and intends to challenge the interim relief order. Viru County Court granted the application for interim relief, according to which the construction was suspended.
