Tallinna Ringkonnakohtu täielikult õigeksmõistev otsus Selver AS suhtes

Tallinna Ringkonnakohus tühistas 20.01.2016 otsusega kohtuasjas nr 1-14-3730
Selver AS-i ja tema endise töötaja Tiiu Valgu suhtes maakohtu poolt varasemalt
tehtud süüdimõistva otsuse ja mõistis Selver AS-i kasuks välja õigusabikulud.
Selver AS avaldab tema ja endise töötaja suhtes tehtud ringkonnakohtu otsuse
suhtes siirast heameelt.
Tallinna Kaubamaja Grupp AS avaldas 29.04.2014 börsiteate süüdistuse esitamise
kohta tütarettevõttele Selver AS ja 29.04.2015 börsiteate Harju Maakohtu
süüdimõistva kohtuotsuse kohta. Selver AS vaidlustas Harju Maakohtu otsuse
täies ulatuses ringkonnakohtus. Süüdistuse väitel leppisid Selver AS, Rimi
Eesti Food AS, Maxima Eesti OÜ, Prisma Peremarket AS, AS Helter-R ja AS Liviko
kokku teatud viinade jaehindade tõstmises 2009. aastal ning ettevõtteid
süüdistati karistusseadustiku § 400 lg 4 järgi kvalifitseeritud teo
toimepanemises. Selver AS on kogu protsessi vältel pidanud prokuratuuri
süüdistust alusetuks ja mõistetamatuks, sest Selver AS ei ole konkurentidega
mingeid hinnakokkuleppeid kunagi sõlminud.

Title
Tallinn Circuit Court’s total acquittal judgement regarding Selver AS
Message
With judgement dated 20 January 2016 in case no. 1-14-3730 Tallinn Circuit
Court acquitted Selver AS and its former employee Tiiu Valk on all charges and
earlier conviction by the court of first instance. Selver AS was awarded costs
for legal assistance. Selver AS is sincerely glad for circuit court’s ruling
regarding Selver AS and Tiiu Valk.
On 29 April 2014, Tallinna Kaubamaja Grupp AS released a stock exchange
notification regards the prosecution of its subsidiary, Selver AS and on 29
April 2015 a stock exchange notification regarding judgement of conviction by
Harju County Court. Selver AS challenged the judgement of Harju County Court in
full at the circuit court. According to the charge, Selver AS, Rimi Eesti Food
AS, Maxima Eesti OÜ, Prisma Peremarket AS, AS Helter-R and AS Liviko agreed on
raising the retail price on certain vodkas in 2009, and the companies were
accused of committing a crime specified in Subsection 400 (4) of the Penal
Code. Selver AS has regarded the prosecutor’s accusation unfounded and
unreasonable during the entire course of the proceedings, because Selver AS has
never made any price agreements with the competing companies.
