Riigikogu võttis vastu “Monopolidele hinnapiirangute kehtestamise” seaduse
Message
Täna kiitis Riigikogu heaks “Monopolidele hinnapiirangute kehtestamise” seaduse. Seadusega ettenähtud muudatused, mis on kavas jõustada alates 15. juulist 2010, peale seaduse väljakuulutamist Eesti Vabariigi presidendi poolt, määravad AS-ile Tallinna Vesi ja veel 50-60 suuremale vee-ettevõtjale uue regulaatori ning muudavad vee-ettevõtluse majandus- ja kvaliteediregulatsiooni põhimõtteid. Selle muudatuse tulemusel ei ole AS-i Tallinna Vesi majanduslik- ega kvaliteediregulaator enam Tallinna linn, vaid seadus näeb ette, et seda funktsiooni asub alates 15. juulist 2010 täitma Konkurentsiamet. Muutuse mõju AS-i Tallinna Vesi Teenuslepingule on seni veel ebaselge. Ettevõtte teada ei ole Konkurentsiamet, Sotsiaalministeerium, Keskkonnaministeerium ega Tallinna linnavalitsus tänaseks veel kokku leppinud ühtegi kvaliteedistandardit, mida Ettevõtele kehtestada. Lisaks ei ole Ettevõttega arutatud ega ka seaduses määratletud tariifimehhanismi ega metoodikat lubatud tulukuse määra arvutamiseks. Tegu on Teenuslepingu mõistes seadusest tuleneva muudatusega, kuid Ettevõttele teadaolevalt ei tähenda see veel AS-i Tallinna Vesi ja Tallinna linna vahel sõlmitud Teenuslepingu rikkumist. Osapoolte vahel sõlmitud ja aastani 2020 kehtiva Teenuslepingu alusel kokku lepitud teenusstandardid, tariifid ning tariifimehhanism hetkel ei muutu. AS Tallinna Vesi jätkab tegevust vastavalt Tallinna linnaga sõlmitud Teenuslepingu tingimustele kuni uus regulaator otsustab teisiti või kui Teenuslepingu tingimusi rikutakse Eesti Vabariigi või Tallinna linna poolt. Ettevõte on alati täitnud või ületanud oma tegevusele kehtestatud standardeid ning on veendunud, et investeeritud kapitalilt teenitud tulukus on vastavuses rahvusvaheliste parimatel tavadel põhinevate regulatsioonipõhimõtetega. AS Tallinna Vesi konsulteerib oma juriidiliste ning finantsnõustajatega, et paremini mõista seadusemuudatuse mõju ning kaaluda samme, mida Ettevõttel tuleb astuda, et kehtiva Teenuslepingu tingimusi austataks ka edaspidi. Ettevõte informeerib oma investoreid, kui Eesti Vabariigi president seaduse välja kuulutab ning edastab täiendavat informatsiooni edasise tariifikooskõlastuse protsessi kohta. Estonian Parliament passes "Establishing Price Limitations on Monopolies Act"
Message
Today the Estonian National Parliament passed the “Establishing Price Limitations on Monopolies Act”. The amendments, planned to take effect from July 15th, subject to proclamation by the President of Estonia, will change the principles of economic regulation, quality regulation and the regulator of AS Tallinna Vesi and 50-60 other larger water undertakings. The details of this change mean that the City of Tallinn will no longer fulfil the role of economic and quality regulator for AS Tallinna Vesi. It is intended that this function will now be carried out by the Competition Authority from 15 July 2010. The implications of this change for the terms and conditions of Tallinna Vesi's contract are not yet clear. We believe that to date the Competition Authority, the Ministry of Social Affairs, the Ministry of Environment and the City of Tallinn have not yet discussed nor determined any of the quality standards that the Company has to achieve. In addition, in the tariff mechanism and methodology for calculating an allowed rate of return has not been discussed with the Company and is not contemplated within the Act. This is a change of law but as far as we know does not yet constitute a breach of the Services Agreement we have with the City of Tallinn. Currently our performance standards remain the same and there has not been any change to our tariffs nor the tariff adjustment mechanism that we have contractually agreed until 2020. AS Tallinna Vesi will continue to operate in accordance with the terms and conditions of its contract with the City of Tallinn until the new regulator decides otherwise or the terms of the contract are broken by the State of Estonia or the City of Tallinn. The Company has always met or exceeded all performance measures and believes its returns on invested capital are in accordance with accepted norms when international best practice regulatory principles are used. The Company is now consulting with its legal and economic advisors to better understand the implications of this change in law and the actions it needs to take to ensure the terms of the current contract are respected. The Company will keep its investors informed whether the President of Estonia approves the Act and will provide complete information regarding the forthcoming tariff approval process.
