On 6.12.2018, Competition Authority notified AS Tallinna Vesi that the company
can submit its explanations in the on-going supervisory review procedure
regarding the price components serving as a basis of the prices of water
services. Initially, the Competition Authority expected the explanations by
7.01.2019, but accepted on 20.12.2018 the company´s request to extend the
deadline. Tallinna Vesi has to respond by 30.01.2019.
Tallinna Vesi asked the Competition Authority for a deadline extension so that
the company would have sufficient time to thoroughly analyse the Competition
Authority's arguments and form a substantiated position.
The Competition Authority´s supervisory review procedure is linked to the
rejection of the tariff application for Tallinn and Saue City on 4.12.2018.
Currently, the Competition Authority finds the prices of water services provided
by the company in Tallinn and Saue City to be non-compliant with the
requirements specified in the Public Water Supply and Sewerage Act.
On 19.12.2018, the company submitted an appeal against the 19.11.2018 Tallinn
Administrative Court judgment in administrative case 3-14-363 by which the court
dismissed the company's complaints against the Competition Authority for the
compensation for loss of tariff income and for challenging the refusal to review
AS Tallinna Vesi's applications for the approval of water tariffs for 2013-2017.
